بعد انقضاء المواعيد المنصوص عليها في المواد السابقة يرسل قلم الكتاب ملف الطعن إلى النيابة العامة .
وعلى النيابة أن تودع مذكرة بأقوالها في أقرب وقت مراعية في ذلك ترتيب الطعون بالسجل ما لم ترالنيابة العمومية ما يقتضى تقديم نظر أنواع من الطعون قبل دورها .
وبعد أن تودع النيابة مذكرة بأقوالها ، يعين رئيس المحكمة المستشار المقرر وتاريخ الجلسة التي تنظر فيها القضية .
