يجب فى جميع الأحوال أن تودع مسودة الحكم المشتملة على أسبابه موقعة من الرئيس ومن القضاة عند النطق بالحكم و إلا كان الحكم باطلا ، ويكون المتسبب فى البطلان ملزما بالتعويضات إن كان لها وجه .
