على القاضى فى الأحوال المذكورة فى المادة السابقة أن يخبر المحكمة فى غرفة المشورة أو رئيس المحكمة الابتدائية - على حسب الأحوال - بسبب الرد القائم به وذلك للإذن له بالتنحى ، ويثبت هذا كله فى محضر خاص يحفظ بالمحكمة .
