مع عدم الاخلال بحكم المادة (٣٩) لا يجوز لرؤساء ومديرى المصالح الحكومية ووحدات الادارة المحلية والهيئات العامة ووحدات القطاع العام والهيئات الاعتبارية الأخرى والشركات والمؤسسات الخاصة وأصحاب الأعمال الامتناع عن تعيين أى فرد لم يبلغ سن التاسعة عشرة من عمره وكذا المعافين مؤقتا والموضوعين تحت الطلب لأجل معين فى الوظائف الخالية استنادا الى أن موقفهم من التجنيد لم يحدد بصفة نهائية .
