فى تطبيق أحكام هذا القانون تعتبر مستحضرات طبية خاصة المتحصلات والتراكيب التى تحتوى أو توصف بأنها تحتوى على مادة أو أكثر ذات خواص طبية فى شفاء الإنسان أو الحيوان من الأمراض أو الوقاية منها أو تستعمل لأى غرض طبى آخر ولم يعلن عن ذلك صراحة والتى سبق تحضيرها لبيعها أو لعرضها للبيع أو لإعطائها للجمهور للاستعمال من الظاهر أو من الباطن أو بطريق الحقن بشرط ألا تكون واردة فى إحدى طبعات دساتير الأدوية وملحقاتها الرسمية التى يصدر باعتمادها قرار من وزير الصحة العمومية .
وتعتبر من هذه المستحضرات السوائل و[غير مقروء] المعدة للتطهير التى لم تذكر فى دساتير الأدوية وتكون مطابقة للاشتراطات التى يصدر بها قرار من وزير الصحة العمومية وكذلك صبغات الشعر المحتوية على مواد سامة والمركبات التى قواعدها العنبر أو جوزة الطيب .
