1- كل دعوي للقاصر علي وصية أو للمحجور علية علي قيمة تكون منعلقة بأمور الوصاية أو القوامة تسقط بمضي خمس سنوات من تاريخ بلوغ القاصر ين الرشد أو رفع الحجر أوموت القاصر أو المحجور علية .
2- ومع ذلك فإن إنتهت الوصية أو القوامة بالعزل أو بالاستقالة أو موت فلا تبدأ مدة التقادم المذكورة إلا عن تاريخ تقديم الحساب الخاص بالوصاية أو القوامة .
