لا تحال الجرائم المنصوص عليها فى هذا القانون الى النيابة العامة الا بقرار من وزير المالية أو من ينيبه ، ولا ترفع الدعوى الجنائية الا بناء على طلبه .
ويجوز لوزير المالية حتى تاريخ رفع الدعوى الجنائية الصلح مع الممول على أساس أداء الضريبة المستحقة علاوة على دفع مبلغ يعادل مثلى ضريبة النسبية وثلاثة أمثال الضريبة النوعية التى لم تؤد فى مقابل التنازل عن رفع الدعوى الجنائية .
كما يكون لوزير المالية الصلح بعد رفع الدعوى وقبل صدور حكم نهائى على أساس دفع قيمة الضريبة المستحقة علاوة على مبلغ يعادل ثلاثة أمثال الضريبة النسبية وخمسة أمثال الضريبة النوعية التى لم تؤد .
وتنقضى الدعوى الجنائية بالصلح .
