يؤخذ رأى الدائنين خلال الاجتماع المنصوص عليه فى المادة ( ١٨٩ ) من هذا القانون
فى أمر تقرير إعانة من أموال التفليسة للمفلس أو لمن يعولهم .
وإذا وافقت أغلبية الدائنين الحاضرين على تقرير الإعانة للمفلس أو لمن يعولهم وجب
على قاضى التفليسة ، بعد أخذ رأى أمين الاتحاد ورأى المراقب ، تعيين مقدار الإعانة .
ويجوز لأمين الاتحاد وكذا المفلس أو من يعولهم ، الطعن أمام المحكمة فى قرار
قاضى التفليسة بتعيين مقدار الإعانة ، وفى هذه الحالة يصرف نصف الإعانة لمن تقررت له
إلى حين الفصل فى الطعن .
