للقاضى المختص فى أى مرحلة يكون عليها النزاع تشكيل لجنة تسمى (لجنة إعادة الهيكلة) من الخبراء المقيدين بجدول خبراء إدارة الإفلاس ، وتختص هذه اللجنة بوضع خطة إعادة الهيكلة وإدارة أصول التاجر وتقييمها بالإضافة إلى ما تكلف به من أعمال أخرى . ويتولى القاضى المختص تقدير أتعاب اللجنة .
