Under the Criminal Procedure Law in force today, pretrial detention may not exceed one-third of the maximum custodial sentence for the offence, subject to absolute caps of six months for misdemeanours, eighteen months for felonies, and two years where the offence is punishable by life imprisonment or death. 1

The applicable limit is whichever is lower: the one-third calculation or the relevant absolute cap. 1
