Legal question

Under the Criminal Procedure Law in force today, what is the deadline for an opposition to a default judgment in a misdemeanour case?

Reviewed and approved by a lawyer on 5 October 2026; its citations were checked against the library on 5 October 2026.

For a default judgment in a misdemeanour case, opposition must generally be filed within three days after service of the judgment, in addition to the distance allowance. 1

If the judgment was not served personally on the accused, the period for opposing the sentence starts when the accused learns that service was made; otherwise, opposition remains available until the criminal action is time-barred. 1
