يرفع التظلم إلى اللجنة المشار إليها فى المادة الثالثة ينضم إليها مستشاران تنتخبهما الجمعية العمومية لمحكمة الاستئناف أو قاضيان تنتخبهما الجمعية العمومية للمحكمة الابتدائية على حسب الأحوال .
ويفصل فى التظلم بعد دعوة الخبير بكتاب موصى عليه مصحوب بعلم وصول للحضور لإبداء أقواله .
ويكون قرار اللجنة نهائيا ولو صدر فى غيبة الخبير .
ويبلغ هذا القرار لوزارة العدل .
