يشكل المجلس من رئيس ونائب للرئيس وخمسة وعشرين عضوا من الشخصيات العامة المشهود لها بالخبرة والاهتمام بمسائل حقوق الإنسان ، أو من ذوى العطاء المتميز فى هذا المجال .
ويحل نائب رئيس المجلس محل الرئيس فى حالة غيابه .
ويصدر بتشكيل المجلس قرار من مجلس الشورى لمدة ثلاث سنوات .
