يعفى الممول من تطبيق نظام الدفعات المقدمة فى أى من الحالتين
الآتيتين :
١ - تكبد الممول خسارة ضريبية لمدة سنتين متتاليتين .
٢ - تغيير الشكل القانونى للمنشأة أو الشركة .
وللمصلحة حرمان الممول من تطبيق النظام إذا تبين لها وجود فروق جوهرية بين
تقديرات الممول لأرباحه وبين الأرباح الفعلية التى خضعت للضريبة فى كل سنة يطبق فيها
النظام .
وعلى المصلحة إخطار الممول بذلك بموجب كتاب موصى عليه مصحوبا بعلم
الوصول .
