تقدم المعارضة الى المحكمة التي أصدر رئيسها أمر التقدير أو الى القاضي حسب الأحوال و يصدر الحكم فيها بعد سماع أقوال قلم الكتاب والمعارض اذا حضر و يجوز استئناف الحكم في ميعاد عشرة أيام من يوم صدوره والا سقط الحق في الطعن .
