يوقف صرف المعاش المقرر للمستحق فى الحالات الآتية :
( ا ) الالتحاق بأى عمل والحصول منه على دخل صاف يساوى قيمة المعاش أو يزيد عليه ، فإذا نقص هذا الدخل عن المعاش المستحق صرف إليه الفرق . ويقصد بالدخل الصافى مجموع ما يحصل عليه العامل مخصوما منه حصته فى اشتراكات المعاشات أو التأمين والضرائب .
(ب) مزاولة مهنة تجارية أو غير تجارية منظمة بقوانين أو لوائح لمدة تزيد عن خمس سنوات متصلة ، ويعود الحق فى صرف المعاش فى حالة ترك مزاولة هذه المهنة اعتبارا من أول الشهر التالى لتاريخ ترك المهنة .
