تقدم طلبات الاعفاء من الرسوم حسب الأحوال الى لجنة مؤلفة من اثنين من المستشارين بمحاكم النقض أو الاستئناف وقاضيين بالمحاكم الكلية وقاض بالمحكمة الجزئية ومن عضو نيابة .
ويجب على كاتب المحكمة عند تقديم طلب الاعفاء أن يشعر الخصم الآخر باليوم المعين للنظر في الطلب قبل حلوله .
