يعفى من الرسوم القضائية كلها أو بعضها من يثبت عجزه عن دفعها .
ويشترط في حالة الاعفاء السابق عن رفع الدعوى احتمال كسبها .
ويشمل الاعفاء رسوم الصور والشهادات والملخصات وغير ذلك من رسوم الأوراق القضائية والادارية ورسوم التنفيذ وأجر نشر الاعلانات القضائية والمصاريف الأخرى التي يحتمها الخصوم .
