تنشأ نقابة فرعية بقرار من مجلس النقابة في كل محافظة يبلغ عدد الأعضاء فيها مائة عضو على الأقل فإذا لم يبلغوا هذا العدد يجوز لمجلس النقابة أن يقرر إلحاقهم بأقرب نقابة فرعية لهم أو إنشاء نقابة فرعية خاصة بهم طبقا للقواعد التي يحددها النظام الداخلي للنقابة .
