دون إخلال بحق صاحب الشأن فى الطعن طبقا للقانون إذا أيدت اللجنة المشار إليها فى المادة السابقة القرار الصادر برفض طلب تسجيل العلامة لتشابهها مع علامة أخرى سبق تسجيلها عن منتجات واحدة أو عن فئة واحدة منها فلا يجوز تسجيل هذه العلامة للطالب إلا بناء على حكم قضائى واجب النفاذ .
