يكون لمكتب براءات الاختراع ولذوى الشأن الطعن فى القرار الصادر من اللجنة المنصوص عليها فى المادة (٣٦) من هذا القانون ، وذلك أمام محكمة القضاء الإدارى خلال ستين يوما من تاريخ إخطار المكتب به أو ذوى الشأن بموجب كتاب مسجل موصى عليه مصحوبا بعلم الوصول وتفصل المحكمة فى الطعن على وجه الاستعجال .
