ينشأ بقرار من رئيس مجلس الوزراء مكتب يسمى مكتب حماية الأصناف النباتية ويختص هذا المكتب بتلقى الطلبات المقدمة للحصول على حماية الأصناف النباتية وفحصها والبت فيها ومنح شهادة الحماية ، وذلك طبقا للقواعد والإجراءات التى يحددها قرار الإنشاء .
