فى الأحوال التى تحسب فيها مدة الحماية من تاريخ النشر أو الإتاحة للجمهور لأول مرة ، يتخذ تاريخ أول نشر أو أول إتاحة للجمهور أيهما أبعد مبدأ لحساب المدة ، بغض النظر عن إعادة النشر أو إعادة الإتاحة للجمهور إلا إذا أدخل المؤلف على مصنفه عند الإعادة تعديلات جوهرية بحيث يمكن اعتباره مصنفا جديدا .
فإذا كان المصنف يتكون من عدة أجزاء أو مجلدات نشرت منفصلة وعلى فترات ، فيعتبر كل جزء أو مجلد مصنفا مستقلا عند حساب مدة الحماية .
