يقدم طلب البراءة من المخترع أو ممن آلت إليه حقوقه إلى مكتب براءات الاختراع وفقا للأوضاع والشروط التى تحددها اللائحة التنفيذية لهذا القانون ، ولا يجوز أن يتضمن طلب البراءة أكثر من اختراع واحد ، ويعتبر فى حكم الاختراع الواحد مجموعة الاختراعات التى تشكل فكرة إبداعية متكاملة .
