مع مراعاة أحكام المادة ٥٦ من هذا القانون يشطب
قيد الرهن بناء على حكم أو اتفاق بين الدائن والمدين ، وفي الحالة
الأخيرة يجب أن يقدم المدين إقرارا موقعا من الدائن ومصدقا على
توقيعه بموافقته يفيد موافقته على شطب قيد الرهن.
