للربان الامتناع عن تسليم البضائع التى يجب أن
تسهم في الخسارات المشتركة أو طلب إيداعها إلا إذا قدم صاحبها
ضمانا كافيا لدفع نصيبه من الخسارات، وإذا لم يتفق الطرفان على
الضمان يعرض الأمر على قاضي الأمور الوقتية لتقديره.
