لا يسأل الناقل في حالة نقل الحيوانات الحية عن
هلاكها أو ما يلحقها من ضرر إذا كان الهلاك أو الضرر ناشئا عن
المخاطر الخاصة بهذا النوع من النقل ، وإذا نفذ الناقل تعليمات الشاحن
بشأن نقل هذه الحيوانات افترض أن هلاكها أو ما أصابها من ضرر
نشأ عن المخاطر الخاصة بهذا النوع من النقل حتى يثبت الشاحن وقوع
خطأ من الناقل أو من نائبه أو من أحد تابعيه.
