تلتزم الجهة المختصة بالحقوق التي يكفلها هذا الباب لمدة سنة ميلادية من تاريخ انتهاء خدمة المؤمن عليه وذلك إذا ظهرت عليه أعراض مرض مهني خلالها ، سواء أكان بلا عمل أو كان يعمل في صناعة لا ينشأ عنها هذا المرض .
ويستمر هذا الالتزام بالنسبة للأمراض التى لا تظهر أعراضها إلا بعد انقضاء المدة المشار إليها والتى يصدر بتحديدها قرار من الوزير المختص بالتأمينات بعد أخذ رأى وزارة الصحة .
