يكون للهيئة مجلس إدارة برئاسة وزير التأمينات ويصدر بتشكيله وطريقة اختيار أعضائه وتحديد مكافأتهم قرار من رئيس الجمهورية، على أن يتضمن التشكيل نائبا أو أكثر لرئيس مجلس الإدارة.

يكون لكل من الهيئتين المشار إليهما بالمادة ( ٩ ) مجلس إدارة يصدر بتشكيله وتعيين رئيسه وطريقة اختيار أعضائه وتحديد مكافآتهم قرار من رئيس الجمهورية .
ويمثل المال في مجلس إدارة الهيئة العامة للتأمينات الاجتماعية بأربعة أعضاء تم ترشيحهم من الاتحاد العام للعمال كما يمثل أصحاب الأعمال بالمجلس المذكور رئيس اتحاد الغرف التجارية ورئيس اتحاد الصناعات المصرية .
