يعاقب بالحبس مدة لا تزيد على ثلاثة أشهر ، وبغرامة لا تجاوز خمسين جنيها أو بإحدى هاتين العقوبتين كل من يخالف حكم المادة ٨
ويعاقب بنفس العقوبة صاحب العمل أو من يمثله إذا استخدم أحدا من غير أعضاء النقابة لأداء الأعمال المنوه عنها فى المادة المذكورة .
