إذا رغب أحد الطرفين في فسخ العقد وجب عليه أن يعلن الطرف الآخر كتابة قبل الموعد المحدد لنهاية العقد بشهرين على الأقل إن كانت المدة سنة فأكثر ، أو كان العقد غير محدد المدة ، وشهر على الأقل إذا كانت المدة أقل من سنة .
