مع عدم الإخلال بالحق فى التقاضى، تجوز تسوية أي نزاع ينشأ بين المستثمر وأى جهة أو أكثر من الجهات الحكومية يتعلق برأسمال المستثمر أو بتفسير أحكام هذا القانون أو تطبيقه وديا دون تأخير من خلال المفاوضات بين الأطراف المتنازعة .
