إذا توفى المصاب أو عجز عجزا كليا مستديما من جراء الحادث خلال سنة
من تاريخ وقوعه وثبت بشهادة طبية معتمدة أن الوفاة أو العجز الكلى المستديم
كانا نتيجة الحادث ، وجب على الشركة المؤمنة أن تؤدى إلى المضرور أو ورثته
مبلغ التأمين المستحق عن حالة الوفاة أو العجز الكلى المستديم والمنصوص عليه فى المادة (٨)
من هذا القانون أو أن تكمل مبلغ التأمين الذى سبق ودفعته ليصل إلى هذا الحد .
