الوصية الواجبة مقدمة علي غيرها من الوصايا .
فاذا لم يوصى الميت لمن وجبت لهم الوصية وجبت لغيرهم استحق كل من وجبت له الوصية قدر نصيبة من باقى ثلث التركة ان وفي والا فمنه ومما اوصى به لغيرهم .
تقسيم ما يبقى من الوصية الاختيارية بين مستحقيها .
