اذا كانت الوصية بمرتب من غلة التركة او من غلة عين منها لمدة معينة تقوم او العين محملة بالمرتب الموصى علية وعلي غير محملة به ويكون الفرق بين القيمتين هو القدر الموصى به فان خرج من ثلث المال نفذت الوصية وان زاد علية ولم يجز الورثة الزيادة نفذ منها بقدر الثلث الزائد من المرتب وما يقابله من التركة او العين نورثة الموصى .
الوصية بمرتب مدى الحياة .
