تصح الوصية بالمرتبات من راس المال لمدة معينة ويوقف من مال الموصى ما يضمن تنفيذ الوصية على وجة لايضر بالوارثة .
فاذا زاد ما اوقف لضمان تنفيذ الوصية على ثلث التركة ولم يجز الورثة الزيادة يوقف منة بقدر الثلث وتنفذ الوصية فيه وفي غلته الي ان يستوفى الموصى له قيمة ثلث التركة حين الوفاة او الي ان تنتهى المدة او يموت الموصى له .
