اذا كانت الوصية بكل منافع العين او بعضها وكانت مؤبدة او مطلقة او لمدة حياة الموصى له او لمدة تزيد على عشر سنين قدرت بقيمة العين الموصى بكل منافعها او ببعضها .
فاذا كانت الوصية لمدة لا تزيد علي عشر سنين قدرت بقيمة المنفعه الموصى بها في هذة المدة .
