اذا كانت الوصية بمنفعه لمعين مؤيدة او لمدة حياته او مطلقة استحق الموصى له المنفعه مدة حياته بشرط ان ينشا استحقاقة للمنفعة في مدى ثلاث وثلاثين سنة من وفاة الموصى .
