اذا كانت الوصية بالمنفعه لمعين مدة مدة معلومة المبدا والنهاية استحق الموصى له المنفعه في هذه المدة فاذا انقضت المدة قبل وفاة الموصى اعتبرت الوصية كأن لم تكن واذا انقضى بعضها استحق الموصى له المنفعه في باقيها .
واذا كانت المدة معينة القدر غير معلومه المبدا بدات من وقت وفاة الموصى .
منع ورثة الموصى له بالانتفاع في المدة
