اذا كانت الوصية بحصة شائعه من نوع من اموال الموصي فهلك او استحق في شيء للموصي له وان هلك بعضه او استحق فليس في الباقى ان خرجت من ثلث المال والا اخذا منه بقدر الثلث .
وتكون الوصيه بعدد شائع في نوع من الاموال كالوصية بحصة شائعة فيه .
