إذا كان الموصي له موجودا عند موت الموصي استحق الموصي به من حين الموت ما لم يفد نص الوصية ثبوت الاستحقاق في وقت نعين بعد الموت .
وتكون زوائد الموصي به من حيث المللك إلي القبول للموصي له ولا تعتبر وصية وعلي الموصي له نفقة الموصي به في تلك المدة .
