مع عدم الإخلال بالعقوبات المنصوص عليها فى هذا القانون تخضع المبيعات المهربة والمبيعات التى تتم بالمخالفة للقواعد المقررة قانونا لفئات الضريبة النافذة فى تاريخ وقوع الجريمة أو المخالفة ، فإذا تعذر تحديده خضعت هذه المبيعات لفئات الضريبة النافذة وقت الضبط أو اكتشاف المخالفة .
