يصدر قرار من الوزير المختص بناء على طلب المجلس بتقرير تفرغ ثلاثة على الأكثر من أعضائه العاملين بالجهاز الإدارى للدولة أو القطاع العام أو الهيئات العامة أو الوحدات الاقتصادية التابعة لها .
ويكون تفرغ العضو لمدة سنة قابلة للتجديد ولمدة لا تتجاوز ثلاث سنوات .
وتتحمل الجهة التى يتبعها من يتقرر تفرغهم من أعضاء مجلس النقابة مرتباتهم .
