From 30 May 1940 to 19 May 1957 · by Law 40/1940
يعاقب بالحبس من ستة أشهر الى خمس سنوات وبغرامة من ١٠٠ جنيه الى ٥٠٠ جنيه أو بإحدى هاتين العقوبتين إذا ارتكبت الجريمة فى زمن سلم و بالسجن إذا ارتكبت فى زمن حرب :
( ١ ) كل من ألقى الدسائس الى دولة أجنبية أو الى أحد مأموريها أو كانت له معها مخابرات وقصد بتلك الدسائس أو المخابرات الإضرار بمركز مصر الحربى أو السياسى أو الدبلوماسى .
( ٢ ) كل من أتلف عمدا أو أخفى أو اختلس أو زور أوراقا أو وثائق وهو يعلم أنها تصلح لإثبات حقوق مصر قبل دولة أجنبية .
فإذا كان الجانى موظفا عاما أو ذا صفة نيابية عامة أو موفدا فى مهمة أو عهدت إليه الحكومة بعمل ، تكون العقوبة السجن من ثلاث إلى عشر سنوات إذا ارتكبت الجريمة فى زمن سلم والأشغال الشاقة المؤقتة إذا ارتكبت فى زمن حرب .
