إذا وقع أحد الأفعال المشار إليها في الفقرة الأولى من المادة السابقة بسبب إهمال أو تقصير تكون العقوبة السجن .
فإذا وقعت الجريمة في زمن حرب تكون العقوبة السجن المشدد ، وتكون العقوبة السجن المؤبد إذا ترتب عليها تعطيل العمليات العسكرية .

إذا وقع أحد الأفعال المشار إليها في الفقرة الأولى من المادة السابقة بسبب إهمال أو تقصير تكون العقوبة السجن .
فإذا وقعت الجريمة في زمن حرب تكون العقوبة الأشغال الشاقة المؤقتة ، وتكون العقوبة الأشغال الشاقة المؤبدة إذا ترتب عليها تعطيل العمليات العسكرية .
