لا يسأل جنائيا الشخص الذي يعاني وقت ارتكاب الجريمة من اضطراب نفسي أو عقلي
أفقده الإدراك أو الاختيار، أو الذي يعاني من غيبوبة ناشئة عن عقاقير مخدرة أيا كان نوعها
إذا أخذها قهرا عنه أو على غير علم منه بها.
ويظل مسئولا جنائيا الشخص الذي يعاني وقت ارتكاب الجريمة من اضطراب نفسي
أو عقلي أدى إلى إنقاص إدراكه أو اختياره، وتأخذ المحكمة في اعتبارها هذا الظرف عند
تحديد مدة العقوبة.

لا عقاب على من يكون فاقد الشعور أو الاختيار في عمله وقت ارتكاب الفعل :
إما بجنون أو عاهة في العقل .
وإما لغيبوبة ناشئة عن عقاقير مخدرة أيا كان نوعها إذا أخذها قهرا عنه أو على غير علم منه بها .
