لا عقاب على من ارتكب جريمة ألجأته إلى ارتكابها ضرورة وقاية نفسه أو غيره من خطر جسيم على النفس على وشك الوقوع به أو بغيره ولم يكن لإرادته دخل في حلوله ولا في قدرته منعه بطريقة أخرى .
