يجب على القاضي أن يحكم بالحبس مع الشغل كلما كانت مدة العقوبة المحكوم بها سنة فأكثر وكذلك في الأحوال الأخرى المعينة قانونا .
وفي كل الأحوال الأخرى يجوز الحكم بالحبس البسيط أو مع الشغل .

يجب على القاضي أن يحكم بالحبس مع الشغل كلما كانت مدة العقوبة المحكوم بها سنة فأكثر وكذلك في الأحوال الأخرى المعينة قانونا .
ويجب الحكم دائما بالحبس البسيط في أحوال المخالفات .
وفي كل الأحوال الأخرى يجوز الحكم بالحبس البسيط أو مع الشغل .
