إذا زادت طبقات المبنى أو شققه على خمس وجاوز عدد
ملاكها خمسة أشخاص قام بقوة القانون اتحاد الملاك المنصوص عليه
فى المادة ( ٨٦٢ ) من القانون المدنى وفى تطبيق هذا الحكم يعتبر ملاك الطبقة
أو الشقة الواحدة مالكا واحدا ولو تعددوا .
ويكون للبائع للعقار بالتقسيط عضوا فى الاتحاد حتى تمام الوفاء بكامل أقساط
الثمن ، كما يكون المشترى بعقد غير مسجل عضوا فى الاتحاد .
