لا يجوز تعيين أحد فى وظيفة مدرس ولا تعيين أحد من غير أعضاء هيئة التدريس فى وظيفة أستاذ أو أستاذ مساعد إلا إذا كان موجودا داخل الجمهورية.
ولا يجوز تعيين أحد أعضاء هيئة التدريس فى وظيفة أستاذ أو أستاذ مساعد بعد إنتهاء ما رخص فيه من إعارة أو مهمة علمية أو إجازة مرافقة الزوج إلا بعد عودته إلى العمل، وذلك دون إخلال بحكم المادة (117).
